Section 125 Compliance Documents

Protect Your Business. Reduce Tax Risk. Stay Compliant.

A properly documented Section 125 Plan is essential for any small business offering pre-tax employee benefits. Without it, you may be exposed to unnecessary taxes, penalties, and audit risk.

When your payroll provider manages your Section 125 documentation, compliance becomes simple, automated, and far more secure.

3. Seamless Payroll Integration & Fewer Errors

What's Included

One of the most serious risks for small employers is an IRS audit discovering missing or incomplete Section 125 plan documents.

Without proper documentation:

  • Pre-tax benefit deductions can be disallowed
  • Employers may be liable for back taxes and penalties
  • Employee benefits may become fully taxable retroactively

With compliant documentation in place—and especially when maintained through your payroll provider—you have a clear, organized compliance record that helps protect your business in the event of an audit.

1. Audit Protection & Reduced IRS Risk

A Section 125 plan allows employees to pay for eligible benefits using pre-tax dollars. But this tax advantage only applies if your plan is properly documented.

Without valid plan documents:

  • Pre-tax deductions may be reclassified as taxable income
  • Employers may owe back payroll taxes
  • Penalties and interest can accumulate quickly

Proper documentation ensures your tax savings remain legitimate and protected.

2. Avoid Unexpected Tax Liability

When your payroll company handles Section 125 documentation, everything works together:

  • Plan rules are automatically aligned with payroll deductions
  • Employee benefit elections are correctly applied
  • Administrative errors and manual tracking are minimized

This reduces time spent on HR administration while improving accuracy and compliance consistency.

4. Lower Cost Than DIY Compliance or Legal Fixes

Handling Section 125 compliance without structured documentation can become expensive if issues arise later.

Potential costs of non-compliance include:

  • Attorney and benefits consultant fees
  • Payroll corrections and amended filings
  • IRS penalties and resolution costs

By contrast, payroll providers that include compliant Section 125 documentation help you avoid these costs upfront—often at a fraction of the price of fixing problems later.

Section 125 plan documentation is not optional paperwork- it's critical compliance safeguard.

Office Spotlight

Stop by our South Carolina office in Myrtle Beach and you'll be greeted with a warm smile and  friendly faces.

Danny Barnhill, started his successful payroll company, PaySouth, in 1997. He and the rest of the Myrtle Beach team joined forces with ConnectPay in April of 2026. As a small business owner for 37 years — 29 of those being in payroll — Danny has been a big part of the Myrtle Beach community. That's just one of the reasons we're so happy to have him on board — that strong local presence is what keeps ConnectPay's service top notch.

Spend an afternoon with the team!

Our lovely office manager Tina, along with payroll specialists Kathy and Bill, truly embody the meaning of Southern hospitality, and they bring that warmth to their work every day. This team of four has 90 years of payroll experience combined!  They put their heads together to recommend a few neighborhood spots for a great lunch or a leisurely afternoon in the area. Both Maryland Fried Chicken and Quagliata Brothers Italian Deli are office favorites — and they also happen to be valued clients of ours!

If your car needs a little love, you can drop your car off at Auto Village Center, a wonderful family owned business that has been serving the community for 30 years, and a tune up while you grab lunch!

Afterward, you can do a little shopping at the Tanger Outlets and walk around Barefoot Landing. While you're there, be sure to grab a cool sweet treat to enjoy on the beach. Did we mention that Ricarridis Italian Ice  is one of our sweetest clients in the area? Put us down for a mango-strawberry combo please!

We hope you enjoyed this little tour of Myrtle Beach and look forward to sharing local favorites from our other offices too! Learn more about this office here!

People Spotlight

David Carreno,

If you ever get a phone call from David Carreno, our Compliance Coach, you can look forward to a warm, genuinely helpful conversation.

As a former small business owner himself, David knows firsthand that running a company means wearing a dozen different hats—and that compliance isn't always top of mind when you're focused on daily operations.

"I understand many of the challenges business owners face," David says. "It allows me to connect with our clients and help them navigate compliance requirements with empathy and practical insight. It's rewarding to help fellow business owners avoid blind spots so they can stay focused on growing."

Shedding Light on the Hidden Gaps

In his day-to-day role, David reaches out to ConnectPay clients to help identify areas where small businesses might be exposed to unnecessary risks. He educates owners on tools that can bolster their payroll and tax compliance—ranging from timeclocks and 401(k) integrations to HR resource software.

One of the most common blind spots he encounters? Section 125 compliance documents.

"Many clients don’t know they need formal documentation to ensure that taking money out of payroll pre-tax for healthcare is legal and fair to all employees," David explains. Without the proper documents, businesses can face steep penalties. Fortunately, David is an expert at walking clients through these complexities and connecting them with ConnectPay's affordable, constantly updated solutions.

A Lifelong Learner with a Big Heart

David describes himself as a lifelong student, a trait reflected in the multiple degrees and educational achievements he has earned over the years. That passion for continuous learning is exactly what makes him such a fantastic educator for our clients.

When he isn’t diving into compliance regulations, David and his wife dedicate their time to an incredibly meaningful life mission: serving as foster parents. "Serving foster children is one of our biggest passions," David shares. "It has been an incredibly rewarding experience for our family."

He is also a major coffee enthusiast. Not only does he roast his own beans, but he also proudly claims to make the "world's best cup of coffee"—a title he defends with a nod to the movie Elf. When he isn't brewing a perfect cup, you can usually find him out on the disc golf course.

The feeling is entirely mutual. David's dedication, unique background, and kind nature make him an invaluable asset to the ConnectPay family and the businesses we serve.

People Spotlight

For Chris Conry, ConnectPay’s CISO, navigating the fast-paced world of cybersecurity requires the same focus, adaptiveness, and precision he relies on when stepping up to a tee box on the golf course. Whether he’s mapping out long-term strategy or unwinding on the green—most recently on a bucket-list trip to the golf mecca of Scotland—Chris brings an engaging, hands-on approach to everything he does.

A Dynamic Day-in-the-Life

Chris loves that no two days look the same. His schedule moves between setting high-level security strategy and getting hands-on to build the tools and dashboards that power ConnectPay’s security program. Much like keeping up with his energetic border collie, Chesney, his daily work keeps him on his toes as he collaborates across IT, product, marketing, operations, and finance to make the company measurably safer.

Security as a Business Enabler

With a career background in CISO and CIO roles across tech companies, Chris believes security must enable the business, not block it. Instead of managing risk through static spreadsheets, Chris built a centralized internal operating platform to manage risk and compliance. As an AI-augmented builder, he uses AI tools to design faster—applying the same strict governance guardrails he sets for the company. It’s a "practice what you preach" mindset shaped by thoughtfulness and early collaboration.

Mission, Builder Culture, and Family

What keeps Chris energized at ConnectPay is the builder culture and the core mission: helping small and mid-sized businesses get people paid accurately and on time. That strong sense of purpose extends closely to his personal life. Chris and his wife, Wendy, are deeply devoted to their growing family, which includes four adult children, three grandchildren under three, and an upcoming family wedding next June.

At ConnectPay, Chris continues to build solutions that protect our clients while helping the business move faster—proving that with the right strategy, security and innovation go hand in hand. That's why we are so happy to have him on our team!
